Can you hire a replacement car if the accident was not your fault?
Yes, you can hire a replacement car in Sydney after a not-at-fault accident. Drive Tribe hires the car to you as a normal hire. In NSW, a not-at-fault driver may be able to recover the reasonable cost of a comparable replacement car from the at-fault driver's insurer while their car is repaired. Whether and how much is decided by that insurer or, if disputed, by a court.
We are not a law firm, insurer or claims manager. We do not give legal advice. If you are unsure of your position, speak to a solicitor. Some drivers hire first and keep the invoice for their claim; others wait for the insurer to confirm. That choice is yours. Either way, the hire is charged to you unless another arrangement is agreed in writing before the car is delivered.
If you need a replacement after a crash, see our accident replacement car Sydney service. For a general overview of the process, read not at fault in a car accident in NSW.
Which car will you get?
We match on type, size and standard. Insurers generally look at whether a replacement is comparable to your own car, so like-for-like is the sensible starting point. If you drove a Range Rover or European SUV, choose from the Range Rover Sport (2023), Range Rover Sport (2022), Range Rover Sport (2018), Audi Q7 Quattro, BMW X7, Mercedes-Benz GLS or Porsche Macan, from $250 a day. If you drove a BMW M, AMG or Audi RS, choose from the BMW M3 Competition G80 xDrive (2024), BMW M3 Competition F80 Stage 1+, BMW M3 Competition F80, Mercedes-AMG C63 S or Audi RS 3 Sportback, from $400 a day.
If you drove a 4WD or ute, choose from the Toyota LandCruiser Prado, Land Rover Defender, Ford Ranger Wildtrak, Toyota HiLux Rogue, Chevrolet Silverado 1500 Trail Boss or Jeep Gladiator Rubicon, from $200 a day. If you drove a Tesla or an EV, choose from the Tesla Model Y, Tesla Model 3 Performance or Porsche Taycan Turbo, from $125 a day. If you drove a seven or eight-seater, choose from the Kia Carnival GT-Line, LDV MIFA Luxe, Toyota Kluger GX or Genesis GV80 7-seat (2023), from $175 a day.
Any upgrade above your usual tier is at your cost. See the full fleet for details.

What should you bring?
Bring your driver licence, which we verify through a trusted third-party provider. Also bring the other driver's name, registration and insurer if known, the claim number, photos of the scene and damage, the police event number if police attended, the repairer's name and estimated repair time, and a card for the bond. The bond is a pre-authorisation hold on your card, not a charge, released after the car comes back. The bond and every fee are shown before you pay.
If you do not have all of these, you can still hire. The more you have, the easier your claim may be. Keep copies of everything. For a checklist of the first day, see the first 24 hours after a not-at-fault accident in Sydney.
Delivery and collection anywhere in Sydney is priced by distance and shown before you pay. You can also collect from the car's base, shown on its page. See all pick-up and delivery locations.
Who pays for a not-at-fault hire car?
You pay Drive Tribe for the hire. In NSW, a not-at-fault driver may be able to recover the reasonable cost of a comparable replacement car from the at-fault driver's insurer. That decision is made by the insurer or, if disputed, by a court. The hire is charged to you as a normal hire unless another arrangement is agreed in writing before the car is delivered. Keep the invoice for your claim.
If you are unsure who will pay, speak to a solicitor. For more on claims, see do I need to claim on my own insurance?.

Not sure who pays?
You pay Drive Tribe for the hire unless another arrangement is agreed in writing before delivery. Keep the invoice for your claim. We do not give legal advice.
Get a quoteCallWhatsAppHow long can you keep it?
You can keep the car for as long as you need it, subject to availability and your booking. In NSW, a not-at-fault replacement car is usually kept while your car is being repaired. The insurer may have a view on how long that should be. If your repair takes longer than expected, you can extend the hire, subject to availability. For more detail, see how long can you keep a not-at-fault replacement car in NSW?.
Longer hires taper. Each car page shows a 'from' Saver rate, and the checkout offers Saver, Flexible and Instant rate plans. The minimum age to self-drive is set per car: 20, 25 or 30. A chauffeured guest is a passenger: no licence check, no minimum age, no bond, no cover to buy. Chauffeured bookings are quoted per job.
If your car is written off rather than repaired, the same general position may apply, but the details are different. Speak to a solicitor if you are unsure.
What are you responsible for during the hire?
You are responsible for fuel, tolls, fines and any damage during the hire, as with any hire. You are also responsible for returning the car on time and in the same condition. Every handover is photographed with you present. Same-tier guarantee: you are never swapped to a lesser car. If your car is unavailable, you are offered one of the same tier or told plainly.
If you damage the car, the bond may be used towards the cost, and you may be liable for more. The bond and every fee are shown before you pay. If you have any questions about responsibility, contact us before you book.

Frequently Asked Questions
Am I entitled to a replacement car if the accident was not my fault?
In NSW, a not-at-fault driver may be able to recover the reasonable cost of a comparable replacement car from the at-fault driver's insurer while their car is repaired. Whether and how much is decided by that insurer or, if disputed, by a court. Drive Tribe hires cars and does not give legal advice. If you are unsure, speak to a solicitor.
Can I hire a car before the other driver admits fault?
Yes. The hire does not depend on fault being settled. It is charged to you as a normal hire, and whether you can recover the cost is decided later by the at-fault driver's insurer or, if disputed, a court. If you are unsure of your position, speak to a solicitor.
Will I have to pay for the hire car?
Yes. The hire is charged to you as a normal hire unless another arrangement is agreed in writing before the car is delivered. You may be able to recover the cost from the at-fault driver's insurer, but we cannot promise that. The bond and every fee are shown before you pay.
What do I need to bring?
Bring your driver licence, the other driver's name, registration and insurer if known, the claim number, photos of the scene and damage, the police event number if police attended, the repairer's name and estimated repair time, and a card for the bond. Your licence is verified through a trusted third-party provider.
How long can I keep the car?
You can keep it for as long as you need it, subject to availability and your booking. In NSW, a not-at-fault replacement car is usually kept while your car is being repaired. The insurer may have a view on how long that should be. You can extend the hire if needed.
Can I choose a better car than mine?
We match on type, size and standard, because insurers generally look at whether a replacement is comparable to your own car. Any upgrade above your usual tier is at your cost. If you are unsure which car matches yours, ask us and we will help you choose.
Do you deliver?
Yes. Delivery and collection anywhere in Sydney is priced by distance and shown before you pay. You can also collect from the car's base, shown on its page. Every handover is photographed with you present.
Is this legal advice?
