This page summarises the main terms of hiring a vehicle from Drive Tribe. It is a plain-English guide only. Your rental is governed by the Vehicle Rental Agreement you accept when you pay for your booking, together with your booking confirmation and the Fees and Charges schedule. If anything here differs from those documents, they apply.
Drive Tribe is a business of Australian Business Holdings Pty Ltd (ACN 628 053 636 / ABN 22 628 053 636), 69 Phillip Street, Parramatta NSW 2150.
All amounts are in Australian dollars and include GST.
1. Who can drive
Age. You must be aged 20 to 75 at the start of the rental. Some vehicles carry a minimum age of 25, including every BMW M3 in our fleet and every vehicle in our Exotic and Supercar tiers. The minimum age for each vehicle is shown on its listing and in your booking confirmation.
Young Drivers (20 to 24). Drivers aged 20 to 24 at the start of the rental are accepted as Young Drivers on vehicles with a minimum age of 20. Young Driver Cover, +25% of the daily hire, is mandatory and is added to your booking automatically. A Young Driver additional excess of $3,000 applies on top of the damage excess, and a Young Driver cannot reduce their excess by buying a cover option.
Licence. You must hold a current, valid, full unrestricted licence for the class of vehicle. Provisional (P1 and P2) and learner licences cannot drive any of our vehicles. Some of our vehicles are high-performance vehicles that provisional licence holders are prohibited from driving in New South Wales.
Overseas licences are accepted if current and in English, or accompanied by a valid International Driving Permit or a NAATI-certified English translation, subject to our insurer's approved-country list.
Additional drivers. One additional driver may be added to your booking. The fee is $60 per trip on Lifestyle and Luxury vehicles and $100 per trip on Performance, Exotic and Supercar vehicles. An additional driver must meet every requirement on this page and complete verification before driving. Anyone not named on the agreement is not permitted to drive the vehicle, and letting them do so is a serious breach that removes the excess cap.
2. Identity verification
Every booking is accepted subject to verification of your identity, date of birth and driver licence through a trusted third-party provider. Verification happens after you book. It may include checking your identity document and licence, matching a live photograph or selfie to your document, checking against the Australian Government Document Verification Service, and a fraud and risk assessment.
You must complete verification at least 24 hours before your rental starts, or before handover for a booking made inside 24 hours. We send reminders by SMS and email until it is done, and we will call you if it is still outstanding. We cannot hand over a vehicle to an unverified driver.
Where the verified details contradict what you declared when booking, and the difference would have changed your eligibility for the vehicle, your price or your cover, the booking is cancelled without refund under clause 15.4 of the agreement, whatever booking type you chose. Where the difference changes nothing, we simply correct the booking.
3. Booking and payment
A booking is confirmed only when we accept it in writing. We may decline any booking before it is confirmed.
For rentals up to one month, the full rental charge is payable in advance, before handover. Longer rentals are paid in advance on a rolling weekly or monthly basis. Any other amount you owe is payable within 7 days of our request.
How you can pay. The rental charge can be paid by card, cash or bank transfer. A 2% surcharge applies to any amount charged to a card, including the rental charge where you choose to pay it by card, any increase to your booking, and any amount charged to your card after the rental such as settlement charges, tolls and fines. Paying the rental charge by cash or bank transfer avoids the surcharge on the rental charge. The surcharge is shown to you before you pay. It does not apply to the security bond, which is a hold rather than a charge.
A card is stored on every booking. Whichever way you pay the rental charge, a payment card is securely stored with a trusted third-party provider. It is used for the security bond and, under clause 4.4 of the agreement, for any amount properly payable during or after the rental.
4. Security bond
Before handover we place a pre-authorisation hold on your stored card for the security bond. The bond equals the damage excess that applies to your booking, so it depends on the vehicle's tier and the cover you choose:

This is a hold, not a charge. The money is reserved on your card, not taken, and the card surcharge does not apply to it. It is released after the vehicle is returned, inspected, and any charges are settled. If the hold cannot be placed at handover, we cannot hand over the vehicle.
The bond does not cap what you owe. You remain liable for all amounts under the agreement, including the excess, fees, tolls, fines and recovery costs, even where they exceed the bond.
5. Damage and excess
The vehicle is insured. If it is lost or damaged during your rental, you contribute the damage excess per incident. The same excess applies to theft, attempted theft and tampering. The excess applies separately to each incident: two incidents, two excesses.
Your excess depends on the vehicle's tier and the cover you choose before the rental starts. Cover is priced per trip:

Cover must be selected and paid for before the rental starts. It cannot be added afterwards, and it is not available to Young Drivers, who remain on the no-cover excess for the vehicle's tier plus the Young Driver additional excess.
When the excess does not protect you. You are liable for the full cost of loss or damage, not the capped excess, where the loss arises from or is connected with any of the following:
- any prohibited use (section 8)
- any breach of the driver requirements, including an unlicensed, suspended, ineligible or unauthorised driver
- driving under the influence of alcohol or drugs, or refusing a lawful test
- using the wrong fuel, or driving with a known fault or warning light
- damage to the roof, underbody, interior, tyres or wheels caused by wilful, reckless or negligent conduct, or by driving on an unsuitable surface
- taking the vehicle outside New South Wales without approval
- any conduct that lets the insurer refuse or reduce a claim
- failing to keep the vehicle secure, or failing to report an incident as required (section 10)
Damage charges are capped at your excess where it applies. Usage and conduct charges such as kilometres, fuel, cleaning, smoking, tolls and fines are not capped.
6. Kilometres
Your booking includes a total kilometre allowance for the trip, shown on your booking confirmation. You can add a kilometre package when you book.
Kilometres driven over your allowance are charged per kilometre at the rate for the vehicle's tier, shown on your booking page and confirmation:

Excess kilometres are calculated from the odometer readings taken at pick-up and return, and are payable on return.
7. Fuel and other return charges
Petrol vehicles take 98 RON premium unleaded only. Use only the fuel type and grade specified for your vehicle. Return the vehicle with the same fuel level it had at pick-up; we may ask for a receipt. If it is returned lower, the refuelling fee applies: $15 plus 125% of the per-litre fuel cost.
Wrong fuel is not covered by any excess. You are liable for the full cost of draining, flushing, repair and recovery, and for any consequential loss. Do not start or drive the vehicle after misfuelling.

8. How you may use the vehicle
The vehicle is for ordinary private road use on sealed public roads only, driven lawfully, safely and with due care.
The vehicle must not leave New South Wales without our prior written approval.
You must not, and must not let anyone else:
- use the vehicle for any track day, racing, motorsport, competition, time trial, hill climb, drag, sprint, lap, performance test or driver-training event, on a circuit or anywhere else
- do burnouts, drifting, donuts, skids, launch-control abuse or deliberate wheelspin, or drive recklessly, negligently or unlawfully, including in breach of the Road Transport Act 2013 (NSW)
- drive while affected by alcohol or any drug, or otherwise contrary to law
- carry passengers or goods for hire or reward, including rideshare, taxi, hire-car, courier or delivery work, or any commercial use
- drive on any unsealed road, beach, flood-affected, off-road or otherwise unsuitable surface
- tow or push any vehicle, trailer or object
- sub-let, lend, hire out or part with possession of the vehicle, or use it as security
- carry anything dangerous, illegal, or likely to damage or soil the vehicle, or carry more passengers than there are seatbelts
- let anyone other than you or an approved additional driver drive it
- take the vehicle outside New South Wales without our prior written approval
- use it in any way that breaches the insurance policy, or that would let the insurer refuse or reduce a claim
If you engage in a prohibited use, all damage cover and excess protection ends and you are liable for the full cost of any loss or damage. A prohibited use fee also applies whether or not damage is visible: $5,000 or 10% of the vehicle's market value, whichever is greater.
9. Tracking and immobilisation
Every vehicle is fitted with GPS tracking, telematics and a remote immobilisation device. Some vehicles may also carry a forward-facing dashcam; audio is not recorded.
We collect location, movement, speed, engine and diagnostic data, and driving behaviour, for the duration of your rental. This data may be used as evidence of a breach of the agreement.
Where the data indicates a breach, we may send you an automated warning by SMS or email. Continuing or repeating the breach after a warning is a serious breach.
Immobilisation is a starter interrupt only. It can prevent the vehicle from being re-started while it is stationary with the engine off. It cannot stop, slow or disable a moving vehicle, and we will not use it in a way that leaves you stranded somewhere unsafe. We may use it where the vehicle is reported or suspected stolen or is being used without authority, where a prohibited use continues after a warning, where you are otherwise in serious breach, or, on a long-term rental, where a payment is overdue after written notice and at least 48 hours to pay.
Do not disable, remove, obstruct, power down or interfere with the equipment. Doing so is a serious breach and removes the excess cap.

10. Accidents, theft and breakdowns
Report any accident, theft, attempted theft, vandalism, damage, mechanical fault, breakdown or warning light to us as soon as possible and within 24 hours, on 0468 011 118 or info@drivetribe.com.au.
Theft, attempted theft, malicious damage, or any incident involving injury or a third party must also be reported to the Police, and you must obtain a Police event or report number.
At the scene: do not admit fault or liability. Record the details of any other party, vehicle and witnesses, take photographs where it is safe to do so, and give us a full written report.
If a warning light or mechanical fault appears, stop driving as soon as it is safe to do so and contact us. Do not arrange any repair without our written authority.
If the vehicle has to be recovered, towed or relocated because of your breach, abandonment or an incident, you are liable for those costs.
11. Keeping the vehicle secure
Lock the vehicle and engage any immobiliser or security device whenever it is unattended. Never leave the keys in or with the unattended vehicle. Theft cover may be refused if you do not. You are responsible for parking, storage and security of the vehicle while it is in your possession, and you must not modify, repair or interfere with the vehicle, its odometer or any fitted device.
12. Returning the vehicle
Return the vehicle to the agreed location at the agreed time, in the same condition as at pick-up (fair wear and tear excepted), with the same fuel level and all keys, accessories and documents.
There is a 30-minute grace period. After that, a late return fee applies for each hour or part hour, by vehicle class: Lifestyle and Luxury $100, Performance $200, Exotic $300, Supercar $500. If you need more time, get our agreement before the return time.
Extending your trip. Ask us any way that suits you: in person, by phone, by text, by email or in the app. Once we agree, the extra time is part of your rental agreement and every term of it applies, however the extension was agreed, including verbally. An extension is priced as a new rental for the extra time, from its first day: one extra day on a six-day trip is charged at the one-day rate, not the seventh-day rate. Minimum rental periods do not apply to extensions. The kilometre allowance for the extra time is the allowance for a rental of that length, and the 2% card surcharge applies if you pay by card.
If the vehicle is materially overdue and we cannot contact you, we may treat it as being used without our consent, report it to the Police, locate it using GPS, prevent it from being re-started, and recover the costs from you.
We inspect the vehicle on return. Charges for damage, excess kilometres, fuel, cleaning, tolls, fines and other amounts are assessed then and may be charged to your stored card after return.
13. Tolls and fines
Tolls, toll video-matching fees, fines, infringements and penalties incurred during your hire are yours. A toll administration fee of $15 applies per booking where any toll road is used, plus the tolls themselves and any toll-operator video-matching or administration fees.
We will nominate you as the responsible driver for any fine or infringement and provide your details to the authority. A nomination fee of $50 applies per nomination. Because fines and tolls often arrive after your rental has ended, these amounts may be charged to your stored card at any time afterwards.
14. Cancellations
Choose your booking type when you book. The choice and its consequences are shown before you pay.

14.2 Saver and Instant
A Saver booking is offered at a reduced rate, and an Instant booking for immediate confirmation, in exchange for waiving cancellation and refund rights. These bookings are strictly non-refundable: no refund, credit or transfer if you cancel, amend, fail to collect the vehicle, or return it early, for any reason, including change of mind. Instant bookings are non-refundable under any circumstances.
This does not limit your rights under the Australian Consumer Law where we fail to supply the vehicle.
14.3 If we cancel
- For reasons relating to you (suspected fraud, a trust or safety issue, a policy breach, unsuitable behaviour, failed verification, a material discrepancy between your declaration and your verified licence, or any breach of the agreement) we may cancel or refuse handover without refund, whatever booking type you chose.
- For our own operational reasons (the vehicle becomes unavailable, damaged or unroadworthy through no fault of yours) you choose: a comparable substitute vehicle if available, or a full refund.
15. Long-term rentals (one month or more)
- Rent is paid in advance on a rolling weekly or monthly basis and must never fall into arrears. For rentals longer than one month, payment must stay at least one month in advance. If a payment is missed we may suspend the rental and recover or immobilise the vehicle after written notice and at least 48 hours to pay.
- We schedule servicing so it does not usually fall due during your rental. If an ad-hoc service or repair is needed, you deliver the vehicle to our nominated service centre on reasonable notice.
- We pay for scheduled servicing and fair wear and tear repairs. You pay for any repair arising from misuse, neglect, damage, prohibited use or breach.
- Keep tyres correctly inflated and the washer fluid topped up. Tell us before topping up engine oil or coolant, and report any warning light, leak or unusual noise immediately.
- You may end a long-term rental early with at least 30 days' written notice. You remain liable for rent to the end of the notice period; anything paid beyond that is refunded, and the bond is released less any amounts owing.
16. Your rights under Australian Consumer Law
Nothing in our agreement excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where we are liable for a failure to comply with a consumer guarantee that can be limited, our liability is limited, at our option, to resupplying the services or paying the cost of resupply. If any term of the agreement is or would be an unfair contract term, it applies only to the extent it is not unfair, and the rest of the agreement continues.

The agreement is governed by the laws of New South Wales.
