These terms govern your use of drivetribe.com.au and any booking you make through it.
The site is operated by Australian Business Holdings Pty Ltd (ACN 628 053 636 / ABN 22 628 053 636) trading as Drive Tribe, of 69 Phillip Street, Parramatta NSW 2150 ("Drive Tribe", "we", "us", "our").
By using this site you accept these terms. If you do not accept them, do not use the site.
These are the terms of use for the website and booking system. They are not the rental agreement. Your rental itself is governed by the Vehicle Rental Agreement, which is summarised at Rental Policy.
1. Using this site
You may use this site to browse our fleet, make and manage bookings, and contact us.
You must not:
- use the site for any unlawful purpose, or in breach of these terms
- interfere with the site, its security, or its availability to others
- attempt to gain unauthorised access to any part of the site, our systems, or another user's account
- scrape, harvest, copy or republish our content, fleet listings, photography or pricing, whether by automated means or otherwise
- use the site to send spam, or to collect personal information about other users
- misrepresent your identity, age, date of birth, licence status or eligibility to drive
We may suspend or refuse access to anyone who breaches these terms.
2. Bookings made through this site
2.1 A booking request is an offer
Submitting a booking and paying does not oblige us to supply a vehicle. A booking is confirmed only when we accept it in writing, and we may decline any booking before it is confirmed.
When a booking is confirmed, your rental is governed by our Vehicle Rental Agreement together with your booking confirmation and the Fees and Charges schedule. Those documents, not this page, set out your obligations in relation to the vehicle. A plain-English summary is at Rental Policy.
2.2 Eligibility
Before you book, make sure you are eligible. You must:
- be aged 20 to 75 at the start of the rental. Some vehicles carry a minimum age of 25, including every BMW M3 and every vehicle in our Exotic and Supercar tiers. The minimum age for each vehicle is shown on its listing and in your booking confirmation
- hold a current, full, unrestricted driver licence. Provisional (P1 and P2) and learner licences are not accepted
- declare your date of birth and licence status truthfully when booking
- complete our identity and licence verification after booking and before you collect the vehicle
Drivers aged 20 to 24 are accepted as Young Drivers. Young Driver Cover, +25% of the daily hire, is mandatory and is added to the booking automatically.
Every booking is accepted subject to verification of your identity, date of birth and licence through a trusted third-party provider. Verification happens after you book and must be completed at least 24 hours before your rental starts. If the verified details contradict what you declared and the difference would have changed your eligibility, your price or your cover, we may cancel the booking without refund under clause 15.4 of the rental agreement, whatever booking type you chose.
2.3 Booking types and cancellation
When you book you choose a Flexible, Saver or Instant booking. Saver bookings are offered at a reduced rate, and Instant bookings for immediate confirmation, in exchange for waiving cancellation and refund rights. Saver and Instant bookings are strictly non-refundable. The cancellation terms for each type are set out in full at Rental Policy and are shown to you before you pay.
2.4 Payment
Payment is processed by a trusted third-party provider. We do not store your full card details on our systems.
Amounts shown are in Australian dollars and include GST.
You may pay the rental charge by card, cash or bank transfer. A 2% surcharge applies to any amount charged to a card, including the rental charge where you choose to pay it by card, any increase to your booking, and any amount charged after the rental such as settlement charges, tolls and fines. The surcharge is shown before you pay and is not applied where you pay the rental charge by cash or bank transfer.
2.5 A card is stored on every booking
Whichever way you pay the rental charge, a payment card is securely stored with a trusted third-party provider on every booking. It is used for the security bond and, under clause 4.4 of the rental agreement, for any amount properly payable during or after the rental, such as tolls, fines, damage and other charges. You are asked to agree to this when the card is stored.
2.6 Security bond
Before handover a pre-authorisation hold is placed on your stored card for the security bond. The bond equals the damage excess for the cover you chose. It is a hold, not a charge, and it does not carry the card surcharge. It is released after the vehicle is returned and any charges are settled. Amounts by vehicle tier are at Rental Policy.
3. Accuracy of what is on this site
We take care to keep vehicle details, availability and pricing accurate, but:
- Vehicle images are indicative. Colour, trim, wheels, options and model year may differ from the vehicle you receive.
- Availability is not guaranteed until your booking is confirmed. A vehicle shown as available may be booked by someone else before you complete.
- We may substitute a comparable vehicle where the one booked becomes unavailable, damaged or unroadworthy. Where we do, clause 15.5 of the rental agreement gives you the choice of the substitute or a full refund.
- Pricing errors. If a vehicle is listed at an obviously incorrect price, we may decline or cancel the booking and refund you in full. We will tell you before we do.
4. Our content
All content on this site, including text, photography, video, fleet listings, design, layout and the Drive Tribe name and logo, is owned by us or licensed to us, and is protected by copyright and trade mark law.
You may view and print pages for your own personal, non-commercial use. You must not otherwise copy, reproduce, republish, distribute or commercially exploit any of it without our written permission.
5. Content you provide
If you send us photographs, reviews, messages or other content, you keep ownership of it, and you grant us a non-exclusive, royalty-free licence to use it for the purpose it was provided: administering your booking, responding to your enquiry, and resolving any dispute.
We will only use your photographs or reviews in our marketing if you have expressly opted in to that use. We never do so by default, and you can withdraw your permission at any time by contacting us.
You must not send us content that is unlawful, defamatory, infringing, or that you do not have the right to provide.
6. Links to other sites
This site may link to sites we do not control. We are not responsible for their content, or for anything you do on them.
7. Availability
We try to keep the site available, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it at any time.
8. Liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of this site.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where we are liable for a failure to comply with a consumer guarantee that can be limited, our liability is limited, at our option, to resupplying the services or paying the cost of resupply.
If any term of these terms is or would be an unfair contract term, that term applies only to the extent it is not unfair, and the rest continues to apply.
9. Privacy
We handle personal information in accordance with our Privacy Policy. That policy explains, among other things, that every vehicle in our fleet is fitted with GPS tracking and telematics, that some vehicles may carry a forward-facing dashcam, and what we collect during your rental. Read it before you book.
10. Changes to these terms
We may update these terms. The current version is always on this page with its effective date. The terms that apply to your booking are the ones in force when the booking was confirmed.
11. Governing law
These terms are governed by the laws of New South Wales. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.
