Why the Offer Is Always Small

There is no conspiracy here, just incentives. An insurer meeting a hire bill wants that bill to
be as small as possible, and the cheapest defensible position is to offer basic transport and see
whether it is accepted. In a large number of cases it is accepted, because most people assume the
first offer reflects a rule rather than a preference.

It does not. The governing principle since December 2021 is that a not-at-fault owner is
entitled to the reasonable cost of a broadly comparable or equivalent vehicle,
following the High Court's unanimous decision in Arsalan v Rixon; Nguyen v Cassim
[2021] HCA 40.

What Broadly Comparable Actually Means

This is the genuinely difficult part, and anyone giving you a confident formula is guessing.
The High Court did not define a precise threshold. It rejected the idea that basic transport is
automatically sufficient, and it did not require identical make and model. The space between
those two points is where disputes now live.

It is not make-for-make

In the cases themselves, Mr Cassim's BMW 535i was replaced with a Nissan Infiniti Q50 and the
Court did not disturb that. So a comparable car from a different manufacturer can plainly qualify.
Insisting on the identical badge is not the test and is not a strong position to take.

The relevant features are the ones you actually lost

A sensible approach looks at the characteristics of the damaged vehicle that mattered. Segment
and size. Seating capacity. Drivetrain, where it is genuinely relevant. Broad performance class.
Towing capability, if the car was used for towing. The point is to identify what was lost rather
than to reach for the most expensive thing available.

Grandeur is not the goal

Hiring something conspicuously more impressive than the damaged car invites exactly the
challenge the Court left open on comparability, and it undermines an otherwise good claim. The
standard is equivalence, not upgrade.

The Practical Evidence That Helps

Because comparability is contestable, the claims that go smoothly are the ones where the
claimant can show their reasoning rather than assert it.

Document what the car was

Make, model, year, variant, and the features that mattered. If it was a seven-seater used for
school runs, that is a fact about the vehicle's role, not a preference. If it towed a boat every
weekend, the same. These facts define what a comparable replacement looks like.

Document what you hired and why

A short written note explaining why the replacement was chosen as the closest reasonable match
is worth far more later than a reconstruction from memory. It costs five minutes at the time.

Keep the timeline

Repair authority, assessor's report, correspondence about parts delays, and the dates. Duration
is one of the three things still genuinely contestable and it is decided on documents.

Do not quietly upgrade

If the only comparable vehicle available is more expensive than your own, say so in writing at
the time and explain why nothing closer was available. That is a very different record from
appearing to have taken an opportunity.

Where the Argument Usually Lands

Three things remain live after the High Court decision, and for prestige claims they matter in
a particular way.

Rate

Prestige hire is expensive, and credit hire rates are typically higher than retail rates. This
is the most common point of attack on a large claim. A rate that is defensible against the market
for genuinely equivalent vehicles is far easier to sustain.

Duration

Prestige repairs take longer. Parts frequently come from overseas, specialist panel work is
slower, and manufacturer-approved repairers have queues. That lengthens hire periods legitimately,
but it also makes duration a bigger number and therefore a bigger target. Evidence of why the
repair took as long as it did is worth keeping.

Comparability

The higher the value of the damaged car, the wider the gap between it and whatever the insurer
offers, and the more likely comparability is disputed. This is the argument that is genuinely
about the prestige element.

Repaired Versus Written Off

These are two quite different situations and the hire period behaves differently in each.

If the car is being repaired

The replacement generally runs for the reasonable repair period. On a prestige vehicle that is
frequently longer than an ordinary repair because parts come from overseas, specialist panel and
paint work is slower, and manufacturer-approved repairers often have a queue. None of that is
your doing, and delay outside your control is ordinarily not held against you. Keep the evidence
of it anyway.

If the car is written off

The position is different. You are generally entitled to a replacement until settlement is
made within a reasonable time, not indefinitely. Once a fair settlement figure has been paid you
are expected to be in a position to replace the vehicle yourself, and continuing to hire well
beyond that point is exactly the sort of thing a defendant will challenge on duration.

Disputes about value make this worse

Prestige write-offs frequently involve an argument about market value, and those arguments take
time. A long valuation dispute does not automatically entitle you to a long hire, so it is worth
getting advice early rather than letting hire charges accumulate while the valuation is fought out.

A Note on Excess and Betterment

Two things people conflate with the hire claim that are actually separate.

Your excess is what you pay your own insurer if you claim on your own policy.
Where another driver is at fault, the excess is ordinarily recoverable from them as part of your
loss, but it is a distinct item from the hire cost. Betterment is the argument
that a repair has left you better off than before, for example new parts on an older car. It
concerns the repair bill rather than the replacement vehicle, and it is worth keeping the two
issues separate when corresponding with an insurer so neither gets muddled into the other.

Things That Weaken an Otherwise Good Claim

Being straightforward about this is more useful than cheerleading.

Keeping the hire car well past the point the repair was finished. Hiring something markedly
grander than the damaged vehicle. Being unable to explain the repair timeline. Signing a credit
hire agreement without reading the part that says what happens if the claim fails. Each of these
gives the other side something real to work with.

Do I have to accept the hatchback the insurer offered?

The offer is a starting position rather than a statement of your entitlement. The principle is the reasonable cost of a broadly comparable or equivalent vehicle. Whether a particular substitution is reasonable turns on the facts, so it is worth getting advice rather than either accepting or refusing on assumption.

Does broadly comparable mean the same make and model?

Quantifying the loss without a hire invoice is a different and less straightforward exercise, which is a good reason to get advice rather than assume you have no claim because you simply went without a car.
