There are usually four parties involved while your car is being repaired: you, your insurer, the at-fault driver's insurer, and the repairer. Sometimes a hire company makes five. Everybody assumes somebody else is paying for the replacement vehicle, and the answer depends on choices made in the first few days that nobody explains at the time.

Who Ultimately Pays

Strip away the process and the answer is simple. The party legally responsible for the cost of
your replacement vehicle is the driver who caused the damage, in practice their insurer. Everything
else is a question of who fronts the money in the meantime and who carries the risk if recovery
fails.

The Four Realistic Arrangements

1. You pay and claim it back

You hire on your own card and recover the cost as part of your damages against the at-fault
driver. You carry the cash flow. You also carry the least risk of an argument about rate, because
you paid an ordinary retail price rather than a credit hire rate.

2. Credit hire

A hire company supplies the car and pursues the at-fault insurer directly. You pay nothing
upfront. They carry the cash flow and the recovery risk, and price accordingly. Read the clause
about what happens if the claim fails, because in most agreements a shortfall can land back on you.

3. The at-fault insurer supplies a car

They arrange a replacement themselves at a rate they control. No shortfall risk for you and no
rate argument later. The thing to check is whether the car offered is broadly comparable to yours,
because that is where these offers usually fall short on a prestige claim.

4. Your own policy's hire benefit

If you claim on your own comprehensive policy, many products include a hire vehicle. It is a
contractual benefit limited by your product schedule, typically a small car for a capped number of
days, and it is a different and usually narrower thing than your entitlement against the at-fault
driver.

Choice of Repairer

This affects the hire period more than people expect, so it is worth getting right early.

Your right to choose

Where you are claiming against the at-fault driver rather than on your own policy, you
generally have latitude to select a repairer. Where you claim on your own policy, your insurer's
approved network and policy terms come into play. Check your product disclosure statement rather
than assuming either way.

Manufacturer-approved repairers

For many prestige vehicles, using a manufacturer-approved repairer preserves warranty and
resale position, and for some structural work the manufacturer requires it. These repairers
frequently have queues, which lengthens the hire period legitimately. If that is why you chose
them, record the reason, because it is a complete answer to a later argument about delay.

Cheapest is not always defensible

Equally, choosing a repairer with a materially longer queue than a comparable alternative for
no articulated reason is the sort of thing that gets picked up when duration is challenged.

Repair Authority: The Step That Stalls Everything

A repairer will not usually start substantial work until the insurer has assessed the vehicle
and issued authority. That gap is one of the largest single contributors to hire duration and it
is almost entirely outside your control.

What you can control is chasing it and documenting that you did. Note the date you reported the
accident, the date assessment was requested, the date it happened and the date authority issued.
Those four dates answer most duration arguments before they start.

When the Repair Takes Longer Than Quoted

Prestige repairs routinely overrun, and the reasons are usually legitimate.

Hidden damage found on strip-down, requiring re-assessment and a supplementary authority. Parts
from overseas. Calibration of driver assistance systems after panel work, which is now a
substantial job in its own right and often outsourced. Paint matching on metallic and multi-stage
finishes.

None of that is your doing. All of it is documentable. Ask the repairer to confirm delays in
writing as they happen rather than reconstructing the story at the end.

When the Repairer and the Insurer Disagree

This is a common and frustrating stall, and it is worth understanding because you are usually
the only party with an incentive to break the deadlock.

The quote gap

Your repairer quotes a figure. The insurer's assessor takes a different view on methodology,
hours, or whether a panel is repaired rather than replaced. Work does not start while that is
argued, and the hire runs the entire time.

Why it happens more on prestige vehicles

Manufacturer repair methods often mandate replacement where a generic assessment would allow
repair, particularly with aluminium panels, bonded structures and anything near a sensor. The
repairer is following the manufacturer's method. The assessor is costing a different one. Both are
being reasonable and nothing moves.

What actually helps

Ask the repairer to put the manufacturer's method requirement in writing and send it to the
assessor. A documented technical basis resolves these far faster than a negotiation about price.
Keep a copy, because that correspondence also explains your hire duration later.

Storage While Everyone Waits

If the vehicle is sitting at a tow yard or a repairer's holding area while the quote is argued,
storage charges may be accruing daily. Those are a separate item from the hire cost and they are
frequently a nasty surprise.

Find out early whether storage is being charged and at what rate, and press for the vehicle to
be moved to the repairing shop where storage is often not charged. This is one of the few places
where a phone call in week one genuinely saves money in week six.

The Handover Back

The deprivation ends when your vehicle is available to you, not when you get around to
collecting it. Return the replacement promptly. Holding it a few extra days for convenience is the
easiest way to give an insurer a concrete point on duration, and the saving is trivial by
comparison.

Inspect your car properly before accepting it back. If the repair is defective and it has to
return, that rectification period is generally part of the same deprivation where the fault relates
to the original damage. Document the return and the reason at the time.

What This Means Practically

Decide the funding arrangement deliberately in the first few days rather than accepting whatever
is put in front of you at the tow yard. Understand that the at-fault insurer ultimately pays either
way, and that the arrangement determines who is exposed if something goes wrong.

Then keep the four dates, the parts correspondence and the repairer's written explanations. The
payment chain is straightforward when the file is complete and becomes an argument when it is not.
